1. Provider and scope

2. Account
Provide accurate contact information, protect credentials and report unauthorized use. Do not violate rights, disrupt the service or store unlawful content.
3. Contract formation and correcting input
Registration creates a free service contract. Before a paid order, we show the service scope, total price, billing period, term, renewal and cancellation conditions. You can review and correct input before submitting an order expressly marked as creating a payment obligation. The paid contract is formed only when you submit that order and we confirm it.
The contract text and these terms are available in German or English. The order confirmation is sent to the account email address. Purchases through Apple or Google are also subject to the respective store's checkout terms.
4. Free, trial, Skipper and payment
Free has no fixed term or fee. Skipper currently costs €4.99 per month or €49.99 per year. VAT-exempt under § 19 UStG (German VAT Act). The 30-day trial requires no payment method and does not convert automatically. Paid subscriptions renew for the selected billing period unless cancelled before that period ends.
Web subscriptions are billed through Stripe. Complete payment details are entered with the payment provider; MyBoatDesk receives only the payment and contract status needed for allocation and plan administration. The total price and currency displayed at checkout apply.
5. Your content
You retain rights in your content and grant only the limited technical rights necessary to provide, secure, sync and export it or share it at your direction.
6. Lasting data rights
Plan expiry or module deactivation does not delete boat records. Reading, search, original download, export, transfer and deletion remain available.
7. Availability, updates and changes
We operate with reasonable care but cannot guarantee uninterrupted or error-free availability. Maintenance, security and necessary changes can temporarily affect functions. We provide function and security updates required to keep the digital service in conformity during the supply period and give notice where user action or installation is needed.
Changes to digital functions are made only within the legal framework. We give reasonable advance notice of material adverse changes and identify the reason, timing and any applicable rights. Mandatory rights relating to digital products remain unaffected.
8. No substitute for professional judgment
Maintenance hints, dates, manual search, reports and future AI outputs organize and assist. They do not replace manufacturer instructions, mandated inspections, diagnosis, navigation, weather assessment or skipper responsibility.
9. Term and cancellation
Free may be ended at any time. Paid web subscriptions may be cancelled at any time with effect at the end of the current billing period. The continuously accessible “Cancel contract” function is available in addition to subscription management. The right to terminate for cause remains unaffected. Store-billed subscriptions are also managed through the relevant store.
Cancelling a paid plan does not delete the account. The account normally moves to Free after the paid period, while existing data rights remain available. Permanent account deletion is a separate process requiring explicit confirmation.
10. Right of withdrawal
Consumers generally have a statutory right to withdraw from a paid contract concluded online. The separate right-of-withdrawal notice explains the period, procedure, effects and model form. The prominently placed online function labelled “Withdraw from contract” is also available during the withdrawal period.
11. Statutory remedies
Statutory remedies apply where a digital product is not supplied or is defective. Depending on the legal conditions, these may include bringing the service into conformity, termination, price reduction and damages. A voluntary trial or free plan does not restrict mandatory rights where the relevant provisions apply.
12. Suspension or termination by MyBoatDesk
We may temporarily suspend affected functions or terminate the contract after appropriate assessment in the event of a material or repeated breach, abuse, a security threat or a legal obligation. Where reasonable, we give prior notice and an opportunity to remedy the issue. Mandatory rights and the continuing rights to read, search, download originals, export, transfer and delete your own data remain available.
13. Liability
Statutory rules apply to intent, gross negligence, injury to life, body or health and other mandatory liability. For a slightly negligent breach of an essential contractual duty, liability is limited to the typically foreseeable loss to the extent permitted by law. Mandatory consumer and product-liability rights remain unaffected.
14. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration body unless a different statutory obligation applies.
15. Final provisions
German law applies without displacing mandatory consumer protections at your habitual residence. Mandatory jurisdiction rules remain unaffected.
